The client was charged with battery on a peace officer pursuant to Penal Code section 243(b), assault on a peace officer pursuant to Montana Penal Code section 241(c), resisting arrest pursuant to Penal Code section 148(a)(1), and disturbing the peace under Penal Code section 415(2). 

The jury reached verdicts finding him Not Guilty of battery on a peace officer, assault on a peace officer, and resisting arrest.  The jury reached these verdicts based on him not battering the officer and any resistance was due to the two police officers’ use of excessive force. 

He was found guilty of the least serious offense of disturbing the peace and was sentenced to one year of unsupervised probation with zero jail time.
